However, the Court has now reasoned that the right to be protected from climate change and the right to a wholesome environment are two sides of the same coin; and given the\u00a0increasing <strong>threat (a suggestion that something unpleasant or violent will happen, especially if a particular action or order is not followed<\/strong>)<strong> <\/strong>from climate change year after year, the time has come to treat the former as a distinct right. It has explained how the <strong>vagaries (unexpected events or changes that cannot be controlled and can influence a situation<\/strong>)<strong> <\/strong>of climate change have an adverse impact on life through factors ranging from\u00a0rising temperatures, storms and droughts to food shortages due to crop failure and shifts in vector-borne diseases. If environmental <strong>degradation (the process in which the beauty or quality of something is destroyed or spoiled<\/strong>)<strong> <\/strong>and climate change lead to acute shortage of food and water, the right to <strong>equality (the right of different groups of people to have a similar social position and receive the same treatment<\/strong>)<strong> <\/strong>will also be violated, as the poorer, under-served communities will not be able to cope with the adversity. The Court\u2019s <strong>emphasis (the particular importance or attention that is given to something<\/strong>)<strong> <\/strong>on climate change came in a case that pitted the concern over multiple deaths of the Great Indian Bustard due to solar power transmission lines against India\u2019s international <strong>obligation (the fact that you are obliged to do something<\/strong>)<strong> <\/strong>to meet its <strong>emission (the act of sending out gas, heat, light, etc<\/strong>)<strong> <\/strong>reduction and increase its energy capacity through non-fossil fuel sources.<\/p>\n\n\n\n<p>The context is a conundrum peculiar to some parts of the country. The Bench was faced with a plea by three Union Ministries \u2014 Environment, Power, and New and Renewable Energy \u2014 seeking <strong>modification (a change to something, usually to improve it<\/strong>)<strong> <\/strong>of the Court\u2019s April 2021 order that sought to protect the critically <strong>endangered (in danger of being harmed, lost, unsuccessful<\/strong>)<strong>\u00a0<\/strong>Great Indian Bustard\u00a0from being killed in collisions with power <strong>transmission (the process of broadcasting or sending out something by radio or television, on the internet, etc., or something that is broadcast or sent out<\/strong>)<strong> <\/strong>lines put up by solar energy companies in Rajasthan and Gujarat. The earlier order had directed that all low-voltage power lines in both \u2018priority\u2019 (where the bird is known to live) and \u2018potential\u2019 (where conservation efforts are going on) areas be laid underground and existing overhead lines <strong>converted (having changed in form or character, or been made suitable for a different use<\/strong>) to underground lines. It had also directed that high-voltage lines in identified areas be shifted below the ground. The modification was sought as conversion to underground lines was technically not possible and too expensive and the <strong>renewable (relating to forms of energy that are produced using the sun, wind, etc., or from crops, rather than those using fuels such as oil or coal<\/strong>)<strong> <\/strong>energy sector was <strong>adversely (in a way that has a negative or harmful effect<\/strong>)<strong> <\/strong>affected by the order, especially because the area had considerable solar and wind energy potential. The\u00a0Court has now asked an expert committee to decide on the extent of underground and overground lines\u00a0and recalled its earlier orders. It is unfortunate that the goal of reducing the country\u2019s carbon <strong>footprint (the amount of space on a surface that something needs<\/strong>)<strong> <\/strong>and the need to protect a critically endangered species are at odds with each other.
